Actually I don't see what law this person has broken. Companies operating surveilance cameras have videoed couples having sex in shop doorways and then sold them to TV programmes.

The report says a public order offence, so I suspect he's been done under Section 5 of the Public Order Act (maybe called something different now since the Police and Criminal Evidence Act - Yorkie?) which basically covers words and behaviour likely to cause a breach of the peace. It doesn't matter that the only people who noticed the relevant behaviour were a store detective and and some coppers.
It's a gross invasion of people's privacy though, and I'm sure any of us who caught someone filming our knickers probably would commit a breach of the peace.
